SHADY COVE MAYORAL CANDIDATE STATES OPPONENT’S APPOINTMENT VIOLATES STATE LAW

 

Things are heating up in the race for mayor in the city of Shady Cove. Shady Cove City Councilor and mayoral candidate Linda Kristich, states that her opponent Lena Richardson, occupies a seat on the city’s Budget Committee in violation of state law.

 

“My opponent was appointed to the city’s budget committee and sits on that body in violation of Oregon state law” Kristich said, citing Oregon Revised Statute (ORS) Section 294.414(4) which states “appointive members of the budget committee may not be officers, agents or employees of the municipal corporation.”

 

Kristich points to Richardson’s Candidates Statement submitted to the Jackson County Elections Office as proof that Richardson has been on the city’s Budget Committee from 2009 to the present while occupying a seat on the Shady Cove Planning Commission since 2012.

 

Kristich notes that a city planning commissioner is an officer of the City of Shady Cove – a municipal corporation under ORS 297.405 – and that Richardson was appointed to sit on the city’s Planning Commission while still seated on the city’s budget committee - a clear violation of ORS 294.414(4) which states “appointive members of the budget committee may not be officers, agents or employees of the municipal corporation.”

 

Kristich further observes that, According to Jackson County real estate records, Richardson built an Accessory Dwelling Unit (ADU) in her Shady Cove home in violation of Shady Cove City Ordinance 225 - an ordinance that Richardson's commission is responsible for enforcing .

 

“A mayor should be a role model, and when I am elected I will work to clean up the way our city operates and to make the workings of our city government more transparent."
